Notice Under ADA

NOTICE UNDER THE AMERICANS WITH DISABLITIES ACT

In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990, Jefferson County, Pennsylvania will not discriminate against qualified individuals with disabilities in its services, programs or activities.

Employment: Jefferson County does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under title I of the Americans with Disabilities Act (ADA).

Effective Communications: Jefferson County will generally, upon request, provide appropriate aids and services leading to effective communication for qualified person with disabilities so they can participate equally in the County’s programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.

Modifications to Policies and Procedures: Jefferson County will make all reasonable modifications policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all County programs, services, and activities. For example, individuals with service animals are welcomed in Jefferson County offices, even where pets are generally prohibited.

Anyone who requires an auxiliary aid or services for effective communication, or a modification of polices or procedures to participate in a County program, service, or activity, should contact the office of William Setree, ADA Coordinator, Jefferson Place, 155 Main Street, 2nd Floor, Brookville, PA 15825, Phone: (814) 849-3047 as soon as possible but no later than 48 hours before the scheduled event.

The ADA does not require Jefferson County to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.

Complaints that a program, service, or activity of Jefferson County is not accessible to persons with disabilities should be directed to William Setree, ADA Coordinator, Jefferson Place, 155 Main Street, 2nd Floor, Brookville, PA 15825, Phone: (814) 849-3047.

Jefferson County will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to persons who use wheelchairs.

ADA (Title II) Policy

AMERICANS WITH DISABILITIES ACT (TITLE II) POLICY

The Unified Judicial System of Pennsylvania (UJS) complies with Title II of the Americans with Disabilities Act (ADA) which provides that “no qualified individual with a disability shall, by reason of such disability, be excluded from participation in or be denied the benefits of the services, programs, or activities of a public entity, or be subjected to the discrimination by any such entity”. 42 U.S.C.A. §12132. Pursuant to that requirement, if you are an individual with a disability who needs an accommodation in order to participate in any judicial proceeding or any other service, program, or activity of the UJS, you are entitled, at no cost to you, to the provision of certain assistance. The ADA does not require the Jefferson County Courts to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.

If you require an accommodation under the ADA, it is recommended that you make your request as soon as possible or at least three (3) business days before your scheduled participation in any court proceeding or UJS program or activity. All requests for accommodation, regardless of timeliness, will be given due consideration and if necessary, may require an interactive process between the requestor and the Jefferson County Courts to determine the best course of action.

Grievance Procedure Under ADA

Grievance Procedure Under The Americans with Disabilities Act

This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act of 1990 (“ADA”). It may be used by anyone who wishes to file a compliant alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by Jefferson County, Pennsylvania. The County’s Personnel Policy governs employment-related complaints of disability discrimination.
The compliant should be in writing and contain information about alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint will be made available for persons with disabilities upon request.

The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later that 60 calendar days after the alleged violation to:

Within 15 calendar days after receipt of the complaint, William Setree, ADA Coordinator or his designee will meet with the complainant to discuss the complaint and the possible resolutions. Within 15 calendar days of the meeting, William Setree, ADA Coordinator or his designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print Braille, or audio tape. The response will explain the position of the County and offer options for substantive resolution of the complaint.

If the response by William Setree, ADA Coordinator or his designee does not satisfactorily resolve the issue, the complainant and/or his/her designee may appeal the decision within 15 calendar days after receipt of the response to the County Commissioners.
Within 15 calendar days after receipt of the appeal, the County Commissioners will meet the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, the County Commissioners will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.

All written complaints received by William Setree, ADA Coordinator or his designee, appeals to the County Commissioners and response from these two offices will be retained by the County for at least three years.

ADA (Title II) Grievance Procedure

AMERICANS WITH DISABILITIES ACT (TITLE II) GRIEVANCE PROCEDURE

This grievance procedure is established for the prompt resolution of complaints alleging any violation of Title II of the Americans with Disabilities Act (ADA) in the provision of services, programs, or activities by the Unified Judicial System (UJS). If you require a reasonable accommodation to complete this form, or need this form in an alternate format, please contact William Setree.

To file a complaint under the Grievance Procedure please take the following steps:

  1. Alternative means of filing complaints will be made available for persons with disabilities upon request. The complaint should be submitted as soon as possible but no later than sixty (60) calendar days after the alleged violation.
  2. Within fifteen (15) calendar days of receipt of the complaint, the ADA Coordinator or his designee will investigate the complaint, including meeting with the individual seeking an accommodation, either in person or via telephone, to discuss the complaint and the possible resolutions. Within fifteen (15) calendar days of the meeting, the ADA Coordinator or his designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, Braille, or audio. The response will explain the position of the Jefferson County Courts and offer options for substantive resolution of the complaint.
  3. If the response to the complaint does not satisfactorily resolve the issue, the complainant may appeal the decision within fifteen (15) calendar days after receipt of the response to Chad Weaver or his designee. With fifteen (15) calendar days after receipt of the appeal, the ADA Coordinator or his designee will meet with the complainant to discuss the complaint and possible resolutions. Within fifteen (15) calendar days after meeting, the ADA Coordinator or his designee will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.

This grievance procedure is informal. An individual’s participation in this informal process is completely voluntary. Use of this grievance procedure is not a prerequisite to and does not preclude a complainant from pursuing other remedy available under the law.

The UJS Policy on Non-Discrimination and Equal Employment Opportunity also encompasses disability-related issues and provides complaint procedures for UJS court users. Any employment-related disability-related discrimination complaints will be governed by the UJS Policy on Nondiscrimination and Equal Employment Opportunity.
